Environmental approval

AGL is committed to protecting the environment and minimising our environmental footprint in the areas we operate, in collaboration with our stakeholders and in alignment with our Environmental Protection Licence 20130 (PDF).

On 18 July 2012, the project received conditional approval from the Commonwealth Department of the Environment. The Department confirmed the project is a controlled action under the Environment Protection and Biodiversity Conservation Act 1999.

The NSW Planning Assessment Commission (PAC) approved AGL's application to construct the NGSF in May 2012 under Section 75J of the Environmental Planning & Assessment Act 1979. This approval is subject to certain conditions (called 'conditions of consent').

PAC's approval incorporates the NSW Department of Planning and Infrastructure (now Department of Planning and Environment) assessment of, and satisfaction with, AGL's Preferred Project and Response to Submissions Report. This report was prepared and submitted by AGL on 12 September 2011 to address the public's comments on the Environmental Assessment (EA).

The EA was on public display from 24 June 2011 to 29 July 2011.

This PAC approval (PDF) and Modification to Approval provides AGL with state government permission to construct and operate the gas plant, pipeline, receiving station and associated and ancillary infrastructure.

The Newcastle Gas Storage Facility holds Environmental Protection Licence (EPL) No 20130 for petroleum products and fuel production at Tomago in the Port Stephen local government area, NSW. Part 5.7A of the Protection of the Environment Operations Act 1997 (NSW) and the Protection of the Environment Operations (General) Regulation 2009 (POEO(G) Regulation), requires AGL as holder of an EPL to prepare, keep, test and implement a Pollution Incident Response Management Plan (PIRMP). A PIRMP has been prepared for the project in accordance with the Environmental guidelines: Preparation of pollution incident response management plans (May 2012).

AGL is required to publish its procedures for communicating with the community and contacting relevant authorities when an incident occurs.
