Please read these terms carefully as it will tell you what you need to know about the terms and conditions of participating in the AGL Offsite Solar pilot program (‘Program’). The Program is an Ancillary Product as defined in your Market Contract. These terms constitute Ancillary Product terms and conditions pursuant to your Market Contract. 

It is agreed as follows.

1 Definitions and Interpretation


1.1 Definitions

In these terms, the following definitions apply unless the context requires otherwise:

AGL Offsite Solar Generation Credit means the credits calculated in accordance with clause 5(c). 

AGL Offsite Solar Loyalty Bonus means the credits calculated in accordance with clause 5(d).

AGL Offsite Solar Subscription means the fees specified in the Fees and Benefits Table.

Allocation means the solar generation generated by the equivalent of a 250 Watt panel within the Offsite Solar Plant.

Applicable Tariff means the tariff specified in the Fees and Benefits Table.

Commencement Date means the date you accept these terms.

Fees and Benefits Table means the table of fees and benefits applicable to the Program and available at the top of this page.

Market Contract means AGL's market retail electricity contract to which these terms are an Ancillary Product.

Offsite Solar Plant means the solar plant described in www.agl.com.au/AGLOffsiteSolar.

Program means the AGL Offsite Solar pilot program.

Regulatory Authority means any governmental or semi-governmental body, including the Australian Energy Market Operator.

Term means the term specified in the Fees and Benefits Table unless otherwise terminated in accordance with clause 8.

1.2 Interpretation

All capitalised terms which are defined in the Market Contract will have the same meaning if used in these terms unless expressly provided to the contrary.


2 Program

(a) You agree to participate in the Program on the terms and conditions set out in these terms.

(b) Provided you comply with your obligations under these terms, during the Term we will provide you with the AGL Offsite Solar Generation Credit and AGL Offsite Solar Loyalty Bonus in accordance with clause 4.


3 Eligibility Criteria for Participation

(a) To participate in this Program, you must, during the Term:

(i) be the account holder for the electricity Market Contract at the Supply Address;

(ii) be on a Market Contract;

(iii) reside in Victoria, New South Wales, South Australia or Queensland; and

(iv) remain the AGL electricity account holder for an eligible Supply Address for the Term.

(b) You must promptly notify us if you are or expect to no longer be eligible to participate in the Program.

(c) You acknowledge and accept the following:

(i) The Program is an ‘Ancillary Product’ within the meaning of your Market Contract and is not the ‘supply of electricity’ and does not form part of an Energy Plan.

(ii) The Program involves the subscription to an Allocation in the Offsite Solar Plant, and payment for an equivalent of the solar generation credits that are derived from the Allocation. 

(iii) You will not be using solar energy generated by the Offsite Solar Plant nor do you obtain ownership or other proprietary rights in any part of the Offsite Solar Plant.

(iv) The amount of AGL Offsite Solar Generation Credit that you will be provided will be calculated by reference to the solar generation of the Offsite Solar Plant, and therefore is subject to variation due to seasonality, weather conditions, faults and regular maintenance. 

(v) AGL will use commercially reasonable endeavours to remove, overcome or minimise the effects of any interruption or reduction as quickly as possible, to the extent that the ability to minimise such effects is within AGL’s commercially reasonable control. If the solar generation of the Offsite Solar Plant is interrupted or significantly reduced for maintenance or repair or for health and safety reasons for a period of more than 7 consecutive days, AGL will determine the AGL Offsite Solar Generation Credits payable to you for each subsequent day based on the 10-year average estimated solar irradiance data from the Bureau of Meteorology in the industry standard solar simulation tool PVsyst or other similar methodology (Estimated Credit Methodology). 

(vi) AGL in its sole discretion may elect to calculate your AGL Offsite Solar Generation Credits using a reasonable estimate of the solar generation of a solar PV system comparable to the Offsite Solar Plant. Any estimates of AGL Offsite Solar Generation Credit that we provide will be based on the Estimated Credit Methodology. 

(vii) Other than as stated in this Agreement, this Agreement does not alter your Energy Plan. For the avoidance of doubt, subscription to the Program does not vary any underlying Rates or Charges specified in your Energy Plan. Any retailer discounts or concessions to which you may be entitled under your Energy Plan will not apply to the AGL Offsite Solar Subscription fees. If your Supply Address is in Victoria, any concessions will be calculated after AGL Offsite Solar Generation Credits or AGL Offsite Solar Loyalty Bonus are applied. If your Supply Address is in Queensland, any concessions will be calculated after AGL Offsite Solar Generation Credits are applied.

4 New Energy Plan or Supply Address

If you change your Supply Address, you may remain in the Program provided that you continue to meet the eligibility criteria specified in clause 3(a), including, that your new Supply Address is in Victoria, New South Wales, South Australia or Queensland.

If you enter into a new Market Contract (including as a result of changing your Supply Address), these terms will be incorporated into your new Market Contract and your Term will continue, provided that you enter into a new Market Contract within 45 days of expiry or termination of your existing Market Contract.


5 Fees and Benefits

(a) For the first year of the Term, you will be charged the AGL Offsite Solar Subscription fees which will be billed in accordance with your Usual Billing Period with your AGL electricity bill.

(b) During the Term, you will receive:

(i) the AGL Offsite Solar Generation Credit; and

(ii) commencing from the second year of the Term, AGL Offsite Solar Loyalty Bonus,

the value of which will be credited to your AGL electricity bill in accordance with your Usual Billing Period.

(c) Subject to clause 3(c), the value of your AGL Offsite Solar Generation Credits will be calculated as the total generation credits generated by the Offsite Solar Plant divided by your Allocation and multiplied by the Applicable Tariff for each day during the Term and as further detailed in the Fees and Benefits Table.

(d) The value of your AGL Offsite Solar Loyalty Bonus will be calculated in accordance with the Fees and Benefits Table.

(e) AGL Offsite Solar Generation Credits and AGL Offsite Solar Loyalty Bonus may only be applied to the cost of AGL products and services on an AGL electricity bill (including your AGL Offsite Solar Subscription fees), are not transferrable and are not redeemable for cash.

(f) You are not entitled to receive a cash equivalent payment if your AGL electricity bill falls below zero. Any outstanding AGL Offsite Solar Generation Credits and AGL Offsite Solar Loyalty Bonus will be carried forward to your next AGL electricity bill.


6 Access to solar performance information

AGL will, via your AGL electricity bill or such other means reasonably determined by AGL, provide you with information and updates on:

(a) the performance of the Offsite Solar Plant; and

(b) your AGL Offsite Solar Generation Credits.


7 Other User Obligations

(a) You agree to participate in surveys, feedback interviews, online discussion forums and other data collection activities reasonably requested by us for the purposes of the Program.

(b) For the avoidance of doubt, you may only subscribe to one Allocation per Supply Address.

(c) Your AGL Offsite Solar subscription is personal to you and may not be assigned or transferred to another person.


8 Duration and Termination of the Program

(a) This Agreement commences on Commencement Date and will continue for the Term unless extended by agreement with you or terminated in accordance with this Agreement.

(b) We may at any time terminate this Agreement for convenience by providing you with 5 Business Days’ notice by giving you written notice. If we terminate this Agreement for convenience, we will refund you all AGL Offsite Solar Subscription fees paid by you prior to the date of Term. You may retain any AGL Offsite Solar Generation Credit and AGL Offsite Solar Loyalty Bonus paid, or payable to you prior to the date of termination. AGL will not be liable for any loss of future earnings as a result of the termination.

(c) As the Program is an Ancillary Product pursuant to your Market Contract, your participation in the Program will end if you terminate your Market Contract for any reason, including if AGL ceases to be Responsible for the sale and Supply of electricity at your Supply Address (other than pursuant to clause 4).

(d) You may also terminate this Agreement for convenience by providing us with 5 Business Days’ notice by contacting us on 13 12 45.

(e) If you terminate this Agreement, your Market Contract (other than pursuant to clause 4) or otherwise become ineligible to participate in the Program, you will cease receiving AGL Offsite Solar Generation Credits and AGL Offsite Solar Loyalty Bonus and will not receive a refund of any AGL Offsite Solar Subscription fees paid by you prior to the date of termination.


9 Liability

You acknowledge and accept that it is your responsibility to consider the suitability of the Program for your personal circumstances.
